Welcome to CreatorMED (hereinafter referred to as “the Site,” “we,” “us,” or “our”).

By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and to comply with all applicable laws and regulations. If you do not agree to these Terms, you are not authorized to use this Site.

Please read these Terms carefully before using the Site. We also encourage you to review our Privacy Policy, which is incorporated by reference into these Terms and governs our collection and use of your information.

1. Acceptance of Terms

Your access to and use of the Site is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Site. By using the Site, you signify your binding agreement to these Terms.

All content provided on this Site, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software (collectively, “Content”), is the property of CreatorMED or its content suppliers and is protected by international copyright laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and make personal, non-commercial use of the Site and its Content strictly for informational purposes. This license does not include:

  • Any resale or commercial use of the Site or its Content.
  • Any collection and use of any product listings, descriptions, or prices.
  • Any derivative use of this Site or its Content.
  • Any downloading or copying of account information for the benefit of another merchant.
  • Any use of data mining, robots, or similar data gathering and extraction tools.

No Content or any part of the Site may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written permission from us. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CreatorMED without express written consent. You may not use any meta tags or any other “hidden text” utilizing CreatorMED’s name or trademarks without our express written consent. Any unauthorized use terminates the permission or license granted by us.

3. User Responsibilities and Conduct (Acceptable Use Policy)

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site. Prohibited behavior includes, but is not limited to:

  • Using the Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site.
  • Using the Site in any way which is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
  • Posting or transmitting any material that is defamatory, offensive, obscene, indecent, abusive, pornographic, harassing, threatening, or otherwise objectionable.
  • Uploading files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or the Site.
  • Conducting any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction, and data harvesting) on or in relation to our Site without our express written consent.
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Violating any applicable local, state, national, or international law.

We reserve the right to terminate your access to the Site for violating any of the prohibited uses.

4. Intellectual Property Rights

All Content, trademarks, service marks, trade names, logos, and intellectual property displayed on the Site are the property of CreatorMED or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to use, reproduce, modify, distribute, or display any of the intellectual property without our prior written consent. Unauthorized use of any of our intellectual property is strictly prohibited and may result in legal action.

5. User-Generated Content (If Applicable – e.g., Comments)

If you post, upload, input, provide, or submit any text, comments, messages, information, or other materials (“User Content”) to the Site:

  • You warrant and represent that you own or otherwise control all of the rights to your User Content, including, without limitation, all the rights necessary for you to provide, post, upload, input, or submit the User Content.
  • You grant CreatorMED a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
  • You agree that you are solely responsible for the User Content that you make available through the Site.
  • We reserve the right, but not the obligation, to monitor and edit or remove any User Content. We take no responsibility and assume no liability for any User Content posted by you or any third party.

6. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by CreatorMED. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that CreatorMED shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

7. Disclaimers of Warranties

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, PRODUCTS, AND SERVICES PROVIDED ON THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CreatorMED  EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND SECURITY AND ACCURACY, AS WELL AS ALL WARRANTIES ARISING BY USAGE OF TRADE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.

WE MAKE NO WARRANTY, AND EXPRESSLY DISCLAIM ANY OBLIGATION, THAT: (A) THE SITE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; (B) THE CONTENT WILL BE UP-TO-DATE, COMPLETE, COMPREHENSIVE, ACCURATE, OR APPLICABLE TO YOUR CIRCUMSTANCES; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR ANY SERVICES OFFERED THROUGH THE SITE WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

IN NO EVENT SHALL CreatorMED  , ITS OWNERS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

  • THE USE OR THE INABILITY TO USE THE SITE;
  • THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE; OR
  • ANY OTHER MATTER RELATING TO THE SITE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT OF ONE HUNDRED U.S. DOLLARS ($100.00 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless CreatorMED  , its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site’s Content, services, and products other than as expressly authorized in these Terms.

10. Privacy Policy

Your use of the Site is also subject to our Privacy Policy. Please review our Privacy Policy, which is available at https://creatormed.com/privacy-policy, which also governs the Site and informs users of our data collection practices. Your agreement to these Terms includes your agreement to our Privacy Policy.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least [e.g., 15-30] days’ notice prior to any new terms taking effect by posting the updated Terms on the Site and updating the “Effective Date” at the top of these Terms. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site. It is your responsibility to check these Terms periodically for changes.

12. Termination

We may terminate or suspend your access to all or part of the Site, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of State of California, USA, without regard to its conflict of law provisions.

You agree that any legal action or proceeding between you and CreatorMED   for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Los Angeles, California, USA.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy [and any other legal notices published by us on the Site], constitute the entire agreement between you and CreatorMED  concerning your use of the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and CreatorMED   with respect to the Site.
